Discrimination Claims Investigation
Discrimination is an intentional as well as unintentional act, which affects employment opportunities because of someone’s race, color, religion, national origin, sex, handicap, marital status, and sometimes even age (in certain jurisdictions).
Discrimination and Harassment Claims are serious, and employers are required to respond accordingly.  An employer’s failure to comply with Federal and State employment and labor laws, can result in the implementation of substantial penalties resulting from lawsuits and defamation.

Discrimination Claims Investigations Information:
  • In the event of discrimination where a claim is being made these are things you need to determine:
  • First determine what agency/municipality has jurisdiction over your claim.
  • File a formal written complaint with that agency, outlining the sequence of events responsible for the alleged action.
  • Be aware of any statute of limitations regulating your ability to file (usually 180 days from the last instance of discrimination).
  • To no ones surprise, being fired or demoted is often a result of your discrimination claim and just adds credence to the situation.
  • If it is determined that discrimination occurred there’s a plethora of actions that could result, even a law suit for damages.​

  • Civil Rights Act of 1964
    • Title VII protects individuals against employment discrimination on the basis of race and color, national origin, sex, and religion, in small and large businesses as well as government agencies.
  • Age Discrimination in Employment Act of 1967 (ADEA)
    • Protects individuals who are over the age of 40 from discrimination based on age and it applies both to applicants as well as current employees.
    • The law states that the employer cannot discriminate on the basis of age with respect to any term, condition, or privilege of employment, including hiring, layoff, benefits, job assignments, compensation, firing, promotion and training
  • Americans with Disabilities Act of 1990 (ADA)
    • Title I of the ADA prohibits private employers, both state and local governments, employment agencies and labor unions from discrimination against qualified individuals with disabilities in job application procedures, hiring, firing, advancement, compensation, job training, and any other terms, conditions, and privileges of employment.
